We are trying to bring this information as quickly as possible and apologize in advance for any incorrect information. The below information, while deemed to be accurate, should be viewed as a general overview. Chronology Superior GrowersConditional Use Application and Appeal
Original submission: Received October 31, 2008 First Hearing: January 12, 2009 Following Hearings: January 29, February 10, March 19, April 16, May 21, June 11, July 16, August 13, October 8, October 15 Final Decision: November 23, 2010 – Supervisors vote 5-0 to deny application – saying the application did not meet the requirements of the zoning Ordinance. December 23: Superior Growers appeals – saying that ordinance requirements would be met in Land Development, not Conditional Use.
December 28: CFACE appeals – saying the township had not concluded that Superior Growers had failed to prove the proposed use would not be injurious to the neighbors and surrounding area. January 25: CFACE submits a Petition to Intervene
February 4th: Superior Growers formally challenged CFACE's right to Intervene and this order is CFACES response demanding clarification for the challenge. View CFACES response here! February 18th: Breif for Appellant and Answer to Petition for Leave to Intervene in Land Use Appeal on behalf of Superior Growers, L.P. View brief here... March 1rst: Motion to consolidate filed by Twp. See the motion here.
March 12th: Superior Growers files a motion to quash legal use appeal See the motion here.
March 15th: CFACE's response to the motion to quash See the motion here.
March 15th: Motion to Stay filed by Twp. See the motion here.
March 16th: Oral arguments scheduled for April 12th, 2010 at 2:30pm . See the motion here.
May 24th: Stipulation filed and hearing held by Judge Nagle on May 24th in Courtroom 8 at 10am. Superior Growers is arguing that CFACE does not have grounds to join the appeal process because we were not aggrieved. See the motion here. July: Judge Nagle Rules that CFACE is not aggrieved and therefore have no grounds for appeal
July 27th: CFACE Files a Notice of Intervention on behalf of several of the parties identified in the proceedings
July27th: An uncontested motion to extend briefings is filed to extend briefings due until August 20th
